# Terms & Conditions

These Terms govern your use of this website and any purchase you make from it. By browsing
or ordering, you agree to them. If you do not agree, please do not use the site.

## 1. Who we are

Carlos Newfood Industry Sdn. Bhd., a company incorporated in Malaysia under the Companies
Act 2016, registration number 202401053674 (1599516-K), registered at 26, Jalan Perdana 3, Taman Segar Perdana, 43200 Cheras, Kuala Lumpur.

## 2. Eligibility

You must be at least 18, or have the consent of a parent or guardian, to place an order.
By ordering you confirm the information you give us is accurate and complete.

## 3. Products

Our products are **fish skin chips**, Halal certified and MeSTI certified, manufactured in
Malaysia.

**Allergens.** Our products contain **fish**. They are produced in a facility that handles
other ingredients — check the packet before eating if you have allergies.

Product photographs are for illustration. Colour, size and the exact appearance of chips
vary naturally between batches. Nutritional information is printed on each packet and
values are typical, not guaranteed to the gram.

Availability is not guaranteed. If an item becomes unavailable after you order, we will
contact you to arrange a substitute, a partial refund or a full refund.

## 4. Prices and payment

All prices are in **Malaysian Ringgit (RM)** and include any applicable tax unless stated
otherwise. Delivery is charged separately and shown at checkout.

We accept FPX online banking, DuitNow QR, Touch 'n Go eWallet, GrabPay, Boost, and credit
and debit cards, processed by a licensed Malaysian payment provider.

We may change prices at any time, but never after you have paid for an order. If a product
is listed at an obviously incorrect price, we may cancel the order and refund you in full.

## 5. Orders

Your order is an offer to buy. A contract forms only when we send you a **confirmation
email**. We may decline or cancel an order where a product is unavailable, payment fails,
we suspect fraud or resale, or the delivery address is outside our service area.

## 6. Membership and rewards

Carlos membership is **free**. Creating an account makes you a member immediately.

**Member benefits, as currently offered:**

**Welcome code.** Issued **once per person** and **single-use**, valid on your first order
only, and not combinable with other discount codes. It has no cash value and cannot be exchanged, resold
or transferred.

**Points.** You earn **1 point for every packet purchased**. New members receive **10 bonus
points** on joining. During your birthday month you earn **double points — 2 points per
packet**. Points are awarded once an order is completed, are not earned on delivery charges,
have no cash value, cannot be exchanged for cash or transferred, and are forfeited if an
order is refunded or an account is closed. We may set an expiry period on unused points with
notice. Redemption values are shown in your account.

**Birthday gift.** Members who have given us an accurate date of birth receive a gift code by
email at the start of their birthday month. The gift currently consists of **Chili Lime trial
packets, a Carlos eco bag and Carlos merchandise**, added free to a qualifying order. The code
may be used **once**, and only **within that birthday month** — it expires on the last day of
the month and cannot be extended, carried over or exchanged for cash or credit. One birthday
gift per member per year. Gift contents may change and are subject to availability; we may
substitute an item of equivalent value. Changing your recorded date of birth may delay
eligibility.

**Fair use.** Benefits are for personal use. We may withdraw benefits, cancel codes, or
suspend or close an account where we reasonably believe it is being used for resale, or
where multiple accounts are created to claim welcome or birthday offers more than once.

**Changes.** Member pricing, points rates and benefits may be changed or withdrawn. Where a
change materially reduces benefits we will give notice by email. Membership itself may be
cancelled by you at any time by closing your account.

## 7. Delivery, returns and refunds

Governed by our **Shipping & Delivery** and **Returns & Refunds** policies, which form part
of these Terms.

## 8. Promotions

Discount codes and promotions apply only as stated, cannot be combined unless we say so,
have no cash value, and may be withdrawn at any time. Bundle pricing applies only to the
bundle as sold and cannot be split across separate orders.

## 9. Intellectual property

All content on this site — the Carlos name and logo, our mascot Karl, product photography,
illustrations, packaging designs and written copy — belongs to Carlos Newfood Industry Sdn.
Bhd. or our licensors. You may not copy, reproduce or use it commercially without our
written permission.

## 10. Customer content

If you send us photos, reviews or other content, or tag us publicly, you grant us a
non-exclusive, royalty-free licence to use it in our marketing, crediting your username
where practical. Tell us in writing if you want it removed.

## 11. Acceptable use

Do not use this site to break the law, interfere with its operation, attempt unauthorised
access, scrape it automatically, or resell our products without our written agreement.

## 12. Liability

We provide the site "as is" and do not guarantee it will always be available or error-free.

Nothing here excludes liability for death or personal injury caused by our negligence, for
fraud, or for anything that cannot lawfully be excluded. Subject to that, our total
liability for any order is **limited to the amount you paid for that order**, and we are
not liable for indirect or consequential loss.

**Always check the packet for allergens and expiry before eating.**

## 13. Force majeure

We are not liable for delays or failures caused by events outside our reasonable control,
including natural disasters, strikes, courier failures, utility outages or government action.

## 14. Changes

We may update these Terms at any time. The version published when you place your order is
the one that applies to it.

## 15. Governing law

These Terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive
jurisdiction. We would rather resolve things directly — contact us first.
